Terms and conditions – Boutique cu Flori

1. Who we are. The website boutiquecuflori.ro is operated by Evelena Bloom S.R.L., registered office at Str. Poligonului nr. 2, Sp. C5, Ploiești, Prahova County, registered with the Trade Register under no. J2019002826295, tax ID RO41666856, share capital 500 lei (“Boutique cu Flori”, “we”). 2. What these terms cover. These terms apply to any order placed on the website by an individual aged at least 18 or by a legal entity (“the customer”). By placing an order, the customer confirms they have read and accept these terms.

3. The order and the contract. The customer chooses the products, delivery or pickup, the date and, for delivery, the time slot, fills in the recipient's details and the card message, then pays. After payment, they receive an order confirmation by email. The contract is concluded when we send this confirmation. We reserve the right to refuse an order, with a full refund, if delivery cannot be made (for example, an address outside the delivery area or an unavailable date).

4. Prices. Prices are shown in lei (RON) and include VAT. The delivery cost is shown separately, before payment, depending on the locality. The price paid is the one shown when the order is placed.

5. Payment. Payment is made online by card through the Stripe payment processor. We do not store card details. The invoice is issued in the name given on the order and sent by email.

6. Products and flower substitution. Arrangements are handmade, so each one is unique. Photos are indicative: the shades, shape and size of the flowers may vary slightly. If a flower is not available on the delivery day, we replace it with one of equal or greater value, keeping the style and colours of the arrangement. If the substitution visibly changes the arrangement, we contact you first and you may choose to cancel the order with a full refund. We guarantee the freshness of flowers and plants for 7 days from delivery, if they are cared for according to the instructions on the care card included with the order. If they wilt sooner, let us know with photos and we will replace the product or refund you.

7. The card message. The message is written by the customer, up to 500 characters, and is copied onto the card exactly as entered. We may refuse messages with offensive or illegal content or that infringe the rights of another person; in that case we contact you before delivery.

8. Alcoholic drinks. Alcoholic drinks are sold only to people over 18 and handed over only to an adult recipient. The courier may ask for ID on delivery. If the recipient cannot prove they are over 18, the drink is not handed over and its value is refunded.

9. Delivery and pickup. Delivery and pickup conditions are described in the Delivery and returns policy.

10. Right of withdrawal. Flowers, plants and floral arrangements are goods that deteriorate quickly. Under art. 16(d) of Government Emergency Ordinance (OUG) 34/2014, there is no 14-day right of withdrawal for them. The same applies to products personalised on request (art. 16(c)), for example wreaths with text on the ribbon. For other products (for example, accessories or teddy bears), the 14-day right of withdrawal applies, as set out in the Delivery and returns policy.

11. Conformity and complaints. We are responsible for the conformity of the products on delivery, under OUG 140/2021. If a product arrives damaged or different from the order, please let us know as soon as possible, ideally the same day, with photos, by phone or email. Possible remedies are replacing the product or a refund.

12. Liability. We are not liable for delays or failed deliveries caused by incorrect or incomplete recipient details, the recipient's absence or force majeure. In such cases we contact you to find a solution.

13. Personal data. We process data according to the Privacy policy.

14. Disputes. We try to resolve any complaint directly, using the contact details above. You may also use alternative dispute resolution through the Romanian consumer protection authority (ANPC) at reclamatiisal.anpc.ro, or the competent courts in Romania.

15. Changes. We may update these terms. An order is governed by the version in force when it was placed.
